1414-1967 Regulating The Keeping Of Grounds And Premises Of Private And Commercial Properties

BEING A BY-LAW FOR REGULATING THE KEEPING OF GROUNDS AND PREMISES OF PRIVATE AND COMMERCIAL PROPERTIES IN THE TOWNSHIP OF AUGUSTA

THE CORPORATION OF THE TOWNSHIP OF AUGUSTA
No. 1414

A By-law for Regulating the Keeping of Grounds
and Premises of Private and Commercial Properties
in the Township of Augusta

The Municipal Corporation of the Township of Augusta
enacts as follows:

1. Every owner, occupier or person using private or
commercial lands and premises in the Township of Augusta shall
keep such lands or premises in accordance with the requirements
hereinafter set out.

2. No owner, occupier or person using private or
commercial lands and premises in the Township of Augusta shall
allow to remain on the said lands any derelict motor vehicle,
engine, farm tractor, wagon or implement, motor-cycle, traction-engine
or harvesting machine, or any horse drawn vehicle or sleigh
unless contained and completely enclosed within a building or
structure thereon.

3. No owner, occupier or user of private or commercial
lands and premises within the Township of Augusta shall allow any
refuse, soil or garbage to accumulate or remain upon such lands,
and without limiting the generality of the foregoing, and derelict
cans, drums, glass, cloth, piping and furniture, unless contained
within a fenced enclosure of such construction as to completely
shield from view the contents, and shall, upon receiving notice
from an officer of the Township designated for the purpose, clean
out and remove forthwith the contents of such enclosure to a
designated dumping area.

4. No owner, occupier or user of private or commercial
lands and premises within the Township of Augusta shall allow
any building or structure on said lands to fall into such state of
disrepair as, in the opinion of the Township officer designated
for such purpose, to have become derelict or unsafe, and shall
forthwith upon notification from such Township officer either
repair or remove such building or structure.,

5. No owner, occupier or user of private or commercial
lands and premises in the Township of Augusta shall allow to
remain on the lands any large quantity of lumber, logs or building
material unless the same is to be used forthwith in the erection
of a structure upon or adjacent to the said lands, or is retained
as stock in trade in the case of a commercial property, except
within such building or structure as to completely shield from
view such lumber, logs or building material, and for the purposes
of this section the Officer of the Township appointed for such
duties shall in his sole discretion decide what constitutes a
“large quantity”,

6. The administrator of this by-law shall be such
appointee or appointees of the Corporation as the Council shall
from time to time designate, by by-law.

7. (a) Any person convicted of a breach of any of the
provisions of this by-law shall forfeit and pay at the discretion
of the presiding Magistrate a penalty not exceeding $300.00 for
each offence exclusive of costs recoverable under the provisions
of the Summary Convictions Act.

(b) Upon a conviction for a breach of any of the
provisions of this by-law, the presiding Magistrate besides imposing
a penalty may order the offender to carry out the requirements
of this by-law within the time to be limited by the order. In
default of the offender carrying out such order, the said Magistrate
may order the Township officer designated for the administration
of the by-law and any other person to forthwith enter upon the
premises where the said breach has taken place and carry out the
order, and the expense and cost for such may be recoverable by
action at the instance of the Corporation or in a matter as
Municipal taxes.

8. All by-laws or sections of by-laws or amendments
thereto inconsistent with the provisions of this by-law are hereby
repealed.

ENACTED AND PASSED this 4th day of June, A.D. 1967.
